Non-compliant bodyshops face €3,000 fine
| Bodyshops that failed to register with their local authority in line with the Decopaints regulations ahead of the March 1, deadline could face fines of up to €3,000 or 12 months in prison, on summary conviction, the Environmental Protection Agency (EPA) had confirmed. “Since 1 March 2008, it is now an offence to operate a vehicle refinishing activity other than in compliance with a current Certificate of Approval from your local authority,” Dr Gerry Byrne of the EPA confirmed. | |
He added: “A person who contravenes or fails to comply with a provision of the Regulations shall be guilty of an offence. Fines of up to €3,000 or imprisonment for up to twelve months, or both, are provided for on summary conviction.” “Such cases may be taken either by the EPA or any local authority.
Many vehicle-refinishing operations have now undertaken or are preparing for their AIC audits. However, now is a risky time to be found in non-compliance as prosecutions are being called for by those who consider themselves to be already in compliance in order to promote a level playing field.”
