24.02.2009 EPA warns on non-compliant paint It is now an offence to offer non-compliant product, whether by way of excessive VOC content or incorrect labelling, for sale. The Enviromental Protection Agency (EPA) has warned. An operator or retailer is obliged in law to report to the EPA if non-compliant product is supplied to them. Similarly, it is also now an offence for any vehicle refinishing operation to allow use of non-compliant product, according to the EPA. EPA inspectors have undertaken numerous inspections over the last year throughout the country at premises supplying paints / materials to the bodyshop sector. Notifications of Non-compliance have been issued where irregularities have been identified. For the most part, non-compliances have been rapidly corrected and further action may not be warranted.
However, if recurring or systematically uncorrected non-compliances are identified, the EPA will not hesitate to bring these to the attention of the Courts as necessary.
